Terms of service
Last updated October 6, 2026. SendSend is currently in an invite-only beta.
These terms are an agreement between you and SendSend (“we”, “us”). By creating an account or using the service you accept them. If you use SendSend for an organization, you confirm you may bind that organization.
1. The service
SendSend provides an API and dashboard for sending, receiving and monitoring email (transactional messages, and email to people who have asked to receive it), using Amazon Web Services as the mail provider. The service is in beta: features, limits and pricing may change, and access is by invitation and review.
2. Your account
- You must give accurate information, including the use-case application we ask for, and keep it up to date.
- Keep API keys and sign-in access secure. You are responsible for activity under your account and keys. Tell us promptly if you think a key or account is compromised.
- New accounts are reviewed before live sending. We may approve, limit, decline or later withdraw approval at our discretion, and we will give you a reason where we can.
3. Acceptable use
You must follow our Acceptable use policy, which is part of these terms. In short: email only to people who expect it or have asked for it, from domains you own, with a working way to unsubscribe from anything that is not a direct response to their action, and never anything deceptive, illegal or unsolicited.
4. Your responsibilities for email you send
- You decide who receives your email and what it says. You are responsible for having the right to send it and for complying with the email, privacy and consumer laws that apply to you and your recipients, including consent and unsubscribe rules where they apply.
- You must verify, through DNS, that you control each domain you send from.
- We automatically suppress addresses that hard-bounce or complain. You must not try to get around suppression.
5. Protecting the service and other customers
Sending reputation is shared. We apply limits and may pause or suspend an account, immediately and without notice where we reasonably think it necessary, if bounce or complaint rates are high, if we suspect abuse or fraud, if you breach these terms, or if our mail provider requires it. We will tell you why and work with you to resolve it where that is possible.
6. Fees and billing
- Paid plans are billed monthly in advance through Stripe, in US dollars, before any taxes. We do not see or store your card number.
- Usage is counted as recipients accepted by the mail provider, including recipients that later bounce. Test-mode sends are free. Optional overage is off by default and stops at the monthly cap you set.
- You can change or cancel your plan at any time from the billing portal. Cancellation takes effect at the end of the paid period. Fees already paid are not refunded except where the law requires it or where we made an error.
- We may change prices or plan limits with at least 30 days’ notice. The changes apply from your next billing period.
7. Your content and data
You own the content of the messages you send and the data you give us. You give us permission to store, process and transmit it only to provide and protect the service. How we handle personal data is described in our Privacy policy.
8. No guarantee of delivery
Email delivery depends on recipients’ mail servers and many factors outside our control. “Delivered” means the recipient’s server accepted a message. We do not promise inbox placement, that a message will be read, or that the service will be uninterrupted or error-free. We do not offer a service-level agreement during the beta.
9. Third-party services
The service relies on providers including Amazon Web Services, Railway, Vercel and Stripe. Their availability and terms can affect the service, and we are not responsible for their acts or omissions beyond what the law requires.
10. Suspension and termination
You can stop using SendSend and close your account at any time by contacting us. We may suspend or terminate your access as described above, or if we stop offering the service, with reasonable notice where possible. When an account closes we delete or anonymize its data as described in the Privacy policy.
11. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim, or CAD/USD $100 if you have paid nothing. Nothing in these terms limits liability that cannot be limited by law.
13. Indemnity
You will defend and compensate us against claims, losses and costs that arise from the messages you send, your breach of these terms or the Acceptable use policy, or your violation of law or of others’ rights.
14. Changes to these terms
We may update these terms. If a change is material we will notify you by email or in the dashboard before it takes effect. Continuing to use the service after that means you accept the updated terms.
15. General
These terms, with the Acceptable use policy and Privacy policy, are the whole agreement between us about the service. If a part is unenforceable, the rest still applies. Neither of us may transfer these terms without the other’s consent, except that we may transfer them as part of a sale or reorganization of our business. They are governed by the laws of the jurisdiction in which SendSend is established, and the courts there have exclusive jurisdiction, unless mandatory consumer law gives you other rights.
